Terms and Conditions for Photo Shooting

  1. General:

    a. The purchase of a photo shoot is an unequivocal acceptance of the following regulations.  

    b. Customers can order a photo shoot via the contact form available on the photo shoots sub-page.  

    c. Customers are required to provide their name, surname, email address, and telephone number in the contact form, ensuring availability  before, during, and after the photo shoot.

  2. Date, Place, and Duration of Photo Shoots:

    a. The date, place, and duration of the shoot are determined individually with the client.  

    b. Changes in point 2a are possible before the advance payment is made.  

    c. Customers can change the place and duration of the shoot up to 3 calendar days before the shoot.  

    d. The shoot duration is counted from the moment the destination is reached until the shoot concludes at that destination. 

    e. If a customer selects more than one location per shoot, transportation time is included in the shoot duration. 

  3. Payment:

    a. The starting rate for a photo shoot is 200 Swiss francs per hour of the photographer's work.  

    b. For a minimum 4-hour shoot and shoots in several different places, prices are determined individually with the client. 

    c. Customers must pay a 50% advance payment of the shoot and other (defined in point 4b) costs 5 calendar days before the agreed shoot  date to the provided bank account.  

    d. Failure to make the advance payment by the given deadline results in the cancellation of the agreed shoot date. 

    e. The remaining 50% of the shoot costs must be paid up to 2 calendar days before the shoot date.  

    f. If a customer changes the shoot date or does not pay the remaining 50% of the costs, the advance payment will not be refunded. 

    g. The price remains the same regardless of the number of participants in the shoot.  

    h. The price of the shoot does not include photo processing. 

  4. Other Costs:

    a. Customers bear travel costs, including travel cost of the photographer and possible tickets for mountain railways. 

    b. Photographer defines their travel cost by car: based on the length in km to the shooting destination, in relation to average price and fuel  consumption; by public transport: according to SBB and Post-Auto fares.  

    c. If a customer selects a location with mountain railways, they will pay the railway cost for the photographer according to the price list at the  destination under Halbtax or half-fare.  

    d. Additional costs, such as meals, are to be covered by the parties themselves.

  5. Photo Processing:

    a. The starting price for photo processing is 50 Swiss francs.  

    b. Prices are determined individually based on the number of photos the customer wishes to receive.  

    c. Customers must familiarize themselves with the photographer's portfolio before the shoot, available on the Portfolio subpage, to  understand the photographer's style and aesthetics.  

    d. Customers must not interfere with photo colors, contrasts, or other parameters. Graphic processing in the form of removing elements  from the picture is not the subject of the service offered in point 5 and cannot be required by the customer. 

    e. The photographer selects the photos for final edition without customer intervention.  

    f. The photographer sends the client a link to the server where photos in JPEG form will be available for download within 14 calendar days  from the shoot date.  

    g. Customers cannot request raw images from the photographer or exchange JPEG photos for others unless the photographer decides to  do so.  

    h. The photographer is obliged to share the photos as per point 5f within 14 calendar days from the date of the shooting. 

  6. Printing Service:

    a. The photographer offers a print service for selected or all photos in JPEG form.  

    b. Photos are printed in Switzerland, in a printing factory chosen by the photographer, and in accordance with the presented price list. 

    c. The maximum possible print size is 60cm x 90cm, determined individually after consulting with the printing factory. 

    d. The client bears the cost of printing, packaging, possible shipping, and additional costs related to the photographer’s work. This cost is  determined individually with the customer.  

    e. The print service is performed after the customer has paid the total costs listed in 6d.  

    f. The photographer is not responsible for the quality of photos printed by the client in a different printing factory, and this will not be the  basis for a photo quality complaint.

  7. Responsibilities of the Photographer and the Client:

    a. The photographer undertakes to perform the service reliably and in accordance with arrangements made with the client. 

    b. The photographer reserves the right to refuse a service against his sense of aesthetics, the agreed concept of the photo shoot, or any  client intervention during the shoot.  

    c. Customers must check whether the chosen photo shoot location is suitable for all participants, including children or people with  disabilities.  

    d. Clients must also check whether the selected shooting place will be available for the duration of the shoot, e.g. places accessible only by  mountain railway.  

    e. The photographer reserves the right to refuse a photo shoot if the selected place raises doubts about safety or interferes with others'  privacy.  

    f. Both the photographer and the client undertake to arrange the time on the day of the shoot to arrive on time, considering weather and  traffic conditions. 

  8. Photo Shooting Using Drone:

    a. Photo shoots using a drone are possible at the customer’s request, and the customer must inform the photographer about it during  arrangements.  

    b. The service is limited to photos only.  

    c. Drone shooting must comply with Swiss regulations.  

    d. The photographer reserves the right to refuse drone services if the shooting place does not permit a flight in accordance with Swiss drone  law.  

    e. Drone shooting is only possible in favorable weather conditions.

  9. Cancellation of the Service:

    a. Cancellation after payment initiated by the customer does not entitle a refund of the advanced or total amount. 

    b. Refund of the advanced and total payment is possible if the reason for cancellation lies with the photographer. 

    c. Client-requested reimbursement is possible with evidence, e.g., a medical certificate, showing the shoot cannot be held. External factors  affecting the shoot, such as cable car malfunctions or bad weather, may lead to a refund or rescheduling by the photographer.
